Welcome to Hunt St, Pty Ltd ("Hunt St"). By accessing and using our website and services, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully. If you do not agree to these Terms, please do not use our website or services.

1. Services Provided

Hunt St is an offshore recruitment agency that assists Australian companies in finding talent from various countries, including but not limited to the Philippines, Nepal, Fiji, Pakistan, India, and other countries. Our services include sourcing, recruiting, reviewing, and presenting candidates for potential employment.

2. Eligibility

By using our website and services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into and abide by these Terms.

3. Confidentiality

All information shared with Hunt St during the recruitment process, including but not limited to personal data and business information, will be treated with the highest level of confidentiality. Hunt St complies with the Privacy Act 1988 (Cth) and relevant data protection laws in the respective countries from which we recruit. For more details, please refer to our Privacy Policy.

4. Independent Contractor Status

Candidates engaged through Hunt St will be hired directly by our clients as independent contractors, not as employees of Hunt St or the clients. Independent contractors are responsible for their own taxes, insurance, and compliance with applicable laws in their respective countries.

5. Intellectual Property

Any intellectual property created by candidates during the recruitment process or while performing services for a client will be the sole property of the client. Candidates agree to assign all rights, title, and interest in any such intellectual property to the client.

6. Compliance with Policies

Candidates and clients agree to comply with all relevant policies and procedures set forth by Hunt St, including but not limited to confidentiality, data protection, and professional conduct. Clients also agree to comply with all relevant workplace health and safety regulations.

7. Fair Work Compliance

Clients agree that any employment contracts facilitated through Hunt St will comply with the Fair Work Act 2009, including provisions on minimum wage, working hours, and employee entitlements.

8. Workplace Health and Safety

Clients agree to ensure that any workplaces where candidates are placed comply with the Work Health and Safety Act 2011, providing a safe working environment for all candidates.

9. Discrimination and Equal Opportunity

Clients agree to conduct all recruitment processes in compliance with the Anti-Discrimination Act 1977 and the Equal Opportunity Act, ensuring no discrimination occurs on the basis of race, gender, age, disability, or other protected characteristics.

10. Superannuation

Clients agree to include provisions for superannuation contributions in all employment contracts facilitated through Hunt St, in compliance with the Superannuation Guarantee (Administration) Act 1992.

11. Consumer Guarantees

Hunt St guarantees that all services provided under this Agreement will comply with the Australian Consumer Law, ensuring they are rendered with due care and skill.

12. Termination and Dispute Resolution

Any disputes arising under these Terms shall be resolved through mediation or arbitration in accordance with the laws of Australia. If mediation or arbitration is unsuccessful, the parties agree to submit to the jurisdiction of Australian courts.

13. Changes to Terms

Hunt St reserves the right to modify these Terms at any time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.

14. Refund Policy

Once a client hires an Introduced Party, any payments referred to in this Agreement are nonrefundable, regardless of whether the candidate leaves or terminates their contract with the client for any reason. Refunds are only applicable to the Initial Deposit if client decides not to hire an Introduced Party. The client is responsible for all taxes, fees, and licenses required to employ or contract with the Candidate.

15. 6-Month Guarantee

Hunt St offers a 6-month guarantee. If a candidate leaves a client's service for reasons other than layoff, workforce reduction, corporate ownership change, or client’s breach of contract within 6 months of the hire, Hunt St will repeat the search at no extra cost. If a candidate fails to meet written job requirements or a client’s policies and is terminated within 6 months, Hunt St will also repeat the search for free. Future searches under this guarantee will be based on the original Services agreed upon. The guarantee period is cumulative for all candidates under this Agreement and does not reset with each replacement. For example, if the original candidate leaves after 1 month, the replacement guarantee is 5 months.
